INTRODUCTION

A characteristic feature of our time is the intensively developing processes of informatization in almost all spheres of human activity. They led to the formation of a new information infrastructure, which is associated with a new type of social relations, with a new reality, with new information technologies. different types activities.

Information technologies are becoming the most important tool for the scientific, technical and socio-economic development of society, playing an essential role in accelerating the processes of obtaining, disseminating and using new knowledge. Influencing the quality of the intellectual resources of society, information technology increases the level and quality of life itself.

Management is difficult process, including the selection and implementation of a certain set of management influences on the current time periods in order to solve the strategic task of ensuring its sustainable financial and socio-economic development. Information technologies greatly expand the possibilities of effective management, since they provide the latest methods for processing and analyzing information necessary for decision-making.

1. GAS "Justice"

In the federal target program "Development of the judicial system of Russia" for 2006-2015, approved by the Government Russian Federation of November 20, 2006 No. 805, tasks were set such as the formation of a single information space, the implementation of constitutional principles of the independence of the judiciary and the independence of judges, ensuring the unity of the judicial system of the Russian Federation, increasing the efficiency of the courts, as well as the implementation of the rights of citizens and legal entities on judicial and legal information.

As part of the federal target program, it is envisaged to create the State Automated System of the Russian Federation "Justice" (hereinafter - GAS "Justice") in the interests of federal courts of general jurisdiction and the system of the Judicial Department.

When creating SAS "Justice", the continuity of software and information systems for automating the activities of officials of the judiciary, the existing property complex in courts of general jurisdiction and the system of the Judicial Department has been preserved, its continuity in daily activities is ensured.

In accordance with the federal target program "Development of the judicial system of Russia" for 2007-20011, since 2007, large-scale work has been launched to introduce information, software and technical solutions of GAS "Justice" in courts of general jurisdiction and regional bodies of the Judicial Department, supply modern equipment.

In the process of implementation and further development of GAS "Justice", much attention is paid to the creation of a unified information space of the judicial system of the Russian Federation on the basis of Automated information technologies in economics and management: Textbook / Ed. 2 Functions of the GAS "Justice" system

Complexes of automation tools of GAS "Justice" are built on the basis of structured local area networks (LAN), which allow to dynamically and quickly increase computing and information resources, the number of network users, including taking into account territorial distribution, logical association of users into segments, distribution of user access to network resources, organization of technological communication rooms, rack placement of technical equipment.

Each level of automation of courts and the hierarchical structure of the Judicial Department has its own set of automation tools, a single one for separately selected objects and replicated for repeated ones. In the structure of each KSA, standard technical solutions are implemented for the same type of functional LAN nodes.

Typical functional units include:

State automated system RF "Justice" is a geographically distributed automated information system, designed to form a unified information space for courts of general jurisdiction and the system of the Judicial Department at the Supreme Court of the Russian Federation (SD), providing information and technological support for legal proceedings based on the principles of maintaining the required balance between the need of citizens, society and the state in the free exchange of information and the necessary restrictions on distribution information.

Taking into account the significant specifics of arbitration proceedings (first of all, openness), as well as the relatively small number of automation objects located in large cities and having access to broadband communication channels, developments in the field of informatization of arbitration courts can be considered more advanced in terms of introducing modern information technologies, but at the same time less applicable within a single judicial system.

For the functioning of the servers of the subsystems GAS "Justice", the following operating systems are considered:

Search system GAS "Justice" launched into industrial operation

The system for storing judicial acts that have undergone the depersonification procedure in accordance with Article 15 of the Federal Law of December 22, 2008 No. 262-FZ "On ensuring access to information on the activities of courts in the Russian Federation" was created in 2014.

The system provides Internet users with an opportunity to obtain information about cases and decisions made in an impersonal form using convenient search mechanisms. A search engine for court cases and court decisions is available on the official website of the Internet portal GAS "Justice" (http://sudrf.ru).

Technically, the source of information for the search engine is the data warehouse of the courts of general jurisdiction and the Supreme Court of the Russian Federation. Therefore, information about cases and decisions made (in an impersonal form) in the search engine of the SAS "Justice" portal is identical to that contained on the websites of individual courts. The system for storing judicial acts, along with the official websites of the courts, is the only reliable source of information about the activities of the courts.

The peculiarity of access to information about cases and court decisions by means of the SAS "Justice" portal is the ability to analyze information in the context of the whole of Russia using flexible search tools, detailing by region, courts, industries, authorities and other criteria.

As a search condition, not only the requisite composition of the judicial act (subject, category of the case, result of consideration, full names of participants, etc.), but also words and phrases appearing in the texts of judicial acts can act. This allows the user to make an end-to-end search through the content of the texts of all available in the database of judicial acts - full-text search.

The ability to combine attributive and full-text search significantly improves search efficiency when selecting cases by subject.

Search tools also allow filtering of the dataset provided by the original query criteria.

Analytical tools of the system of storage of judicial acts allow the user to track events at all stages of the movement of the case, including changes in the status of the consideration of a court case, the fact of the beginning or termination of proceedings, the appointment of the date and time of the hearing, and more.

The system of storage of judicial acts contains more than 33 million court decisions in civil and administrative cases, cases of administrative offenses, criminal cases of courts of general jurisdiction. Updating of the information of the database of the system of storage of judicial acts is provided continuously 24 hours a day.

In addition to decisions of federal courts of general jurisdiction, the search system contains judicial acts and information on cases pending before the Supreme Court of the Russian Federation, including decisions of the judicial board on economic disputes. In accordance with the tender documents, the equipment must be "fully compatible with the software and hardware used in GAS Pravosudiye: Avaya equipment for VoIP telephony and Polycom for videoconferencing equipment."

According to Cnews, the state customer conducts similar tenders on a regular basis, with a frequency of approximately once a year: in the summer of 2014, with an initial maximum contract price of 471 million rubles. the winner was LLC Iterion with a proposal of 468.6 million rubles. The competition does not involve anything other than a Polycom solution. This is a little strange, since the safety issue remains open, and the manufacturer can impose sanctions on the supply of equipment at any time. The company is convinced that it is technically possible to use other servers (not Polycom) based on the existing hardware of the GAS. Although limiting the functionality. Alternative solutions will not differ in price. Because it is necessary to transcode video for hardware terminals. Polycom HDX / Group terminals do not understand protocols other than SIP / H.323. The transition to an alternative server will take a lot of time due to the long-term use of foreign hardware in the considered GAS.

According to representatives of the Russian company Spirit, the trend in the global video conferencing market for 2016 is the transition from hardware systems to software. “That is, the purchase of goods and services for workstations of judges and court employees has been chosen as a priority of informatization of the activities of federal courts of general jurisdiction and magistrates' courts, which clearly does not contribute to the formation of a single information space for the judicial community and does not increase the availability of information about the activities of courts,” they note in the Accounts Chamber.

According to the auditors of the Accounts Chamber, the financing scheme of the center does not meet the requirements of the Budget Code in terms of including budgetary allocations for the purchase of goods, works and services for the informatization of courts: more than 50% of the budgetary allocations provided for ICT procurement were spent without being included in the plan informatization of the judicial department and were not approved by the Ministry of Telecom and Mass Communications.

The Federal Antimonopoly Service (FAS) recognized as justified the complaint of Depo Computers against the auction for the supply of 5.1 thousand computers, as well as a number of other equipment for the retrofitting of automation facilities of the SAS "Justice" for the amount of about 265 million rubles.

All system units must be equipped with LCD LED monitors with a screen diagonal of at least 19 inches and a resolution of at least 1600x900, as well as a UPS with a rated power of at least 700 VA with a rated output voltage alternating current 220V, 50 Hz.

In turn, information kiosks must have at least five PCI-Express expansion slots, at least one 10/100/1000 BaseT Ethernet port, at least one sound adapter, at least six USB ports. Devices must also be equipped with an anti-virus protection tool that works before the OS bootloader starts, and a built-in protection against unauthorized access, certified by FSTEC. Kiosk displays must be vandal-proof touchscreens with surfactant technology, 17-inch diagonal and a resolution of at least 1280x1024.

The second tender is related to the purchase of software and hardware for video conferencing. As stated in the documentation, the purchased PTS VKS are designed to organize real-time communication between courtrooms of the Supreme Court of the Russian Federation, regional and equivalent courts, district courts, city courts, district military courts (OVS), garrison military courts (GVS), as well as with institutions of the Federal Penitentiary Service of Russia.

The software and hardware of the communication and data transmission subsystem (PSPD) and video conferencing must be fully compatible with the software and hardware used in GAS "Justice", namely: with Avaya products - in terms of VoIP-telephony and with Polycom products - in terms of videoconferencing equipment. All software and hardware systems must be provided with a guarantee of at least 36 months from the date of signing the act of acceptance and transfer of goods under the contract.

The total cost of PTS VKS is estimated by the customer at 395 million rubles. The procurement is financed through subsidies from the federal budget. For the supply of goods and their commissioning, the customer set aside the period from the date of the conclusion of the civil law contract until December 16, 2013.

Another 777 million rubles will be allocated for the retrofitting of automation objects of GAS "Justice".

The Information and Analytical Support Center for GAS "Justice" announced in September 2013 an open auction in electronic form for the supply, installation and configuration of software and hardware (audio-video fixation kits) required for retrofitting of automation objects for GAS "Justice".

All work under the state contract is estimated by the customer at 777.98 million rubles. The work is financed by subsidies from the federal budget. Modern technologies play an increasing role in the electoral law of Russia, especially in improving the electoral process. Among them is the use of the State Automated System of the Russian Federation "Elections". At present, the work of the State Automated System of the Russian Federation "Vybory" (hereinafter GAS "Vybory") is regulated by more than 150 different normative legal acts: the Constitution of the Russian Federation, laws of the Russian Federation, decrees of the President of the Russian Federation, resolutions of the Government of the Russian Federation, resolutions of the Central Election Commission of the Russian Federation and regulations of the subjects of the Federation ...

This information system, on the one hand, is the largest geographically distributed multi-level automated system that is used to automate information processes and ensure the activities of election commissions in the preparation and conduct of elections and referenda. On the other hand, it is an objective database of the information society, which ensures democracy by the people, guaranteeing every citizen prompt and reliable receipt of data on the preparation and conduct of elections.

When studying the influence of GAS "Vybory" on the information and legal space, several branches of legal science are affected, and in many respects the norms governing the functioning of GAS "Vybory" have a double sectoral nature. The adopted law on GAS "Vybory" 1 is the first comprehensive legal

The adoption of the law was the result of ten years of work159 related to the implementation of the Decree of the President of the Russian Federation of August 23, 1994 No. 1723 "On the development and creation of the state automated system of the Russian Federation" Elections "160. The society has received a universal tool for monitoring the preparation and conduct of elections using computer technology.

GAS "Vybory" was created together with the formation of the electoral power system itself on the basis of the Constitution of the Russian Federation of 1993, taking into account the Presidential Decree No. 1400 "On Phased Constitutional Reform" 161 of the first provisions on the election of deputies of the State Duma and the Federation Council of the Federal Assembly of Russia162, as well as the first the 1994 Law on Basic Guarantees of Electoral Rights5. It was then that the formation of the concept of GAS "Vybory" took place, its regulatory support and direct development, the creation of GAS "Vybory", including the first experimental and experimental use individual elements system in the by-elections of the State Duma deputy in the Mytishchi single-mandate constituency No. 109 on October 30, 1994 and in the federal elections of the State Duma deputies on December 17, 1995.

Today, the development of GAS "Vybory", as already noted, is based on the Federal Law of January 10, 2003 No. 20-FZ "On the state automated system of the Russian Federation" Vybory "and taking into account the long-term plan for improving the system. Work is underway to convert data from all automation systems of the old version of the system into a single database of GAS "Vybory", transfer of data transmission from GAS "Vybory" to digital communication channels, use, together with the Government of the Russian Federation, system resources when solving problems not related to elections, including on a competitive basis.

The official consolidation of the idea of \u200b\u200busing the GAS "Vybory" took place in the developed Concept for the creation of the State automated system of the Russian Federation "Vybory", approved by the Decree of the Central Election Commission of the Russian Federation on July 12, 1994 "On proposals for the implementation of the State automated system of the Russian Federation" Vybory "163. The general customer of GAS "Vybory" was the Central Election Commission of the Russian Federation (clause 3), which was later enshrined in the Decree of the President of the RF dated August 23, 1994 "On the development and creation of the state automated system of the Russian Federation" Vybory "164 (clause 2). The use of the GAS "Vybory" became one of the guarantees of the implementation of the electoral rights of citizens of the Russian Federation on the basis of ensuring transparency, reliability, efficiency and complete information about elections165.

However, it should be noted that the country's public was ambiguous about the development of the GAS “Vybory” system 166. On the one hand, everyone understood the need to introduce the system in the face of a significantly increased volume of information processed during the election campaign and referendums. On the other hand, lawyers, political scientists, specialists and the public wondered how this system would ensure the reliability of voting results, despite the fact that the CEC of the Russian Federation immediately focused the public on transparency and controllability of both the development and implementation of the system and its functioning.

Therefore, publications sometimes appeared in the press in which the authors argued that the work of the GAS "Vybory" system is closed for access by outside observers and that it is only formally controlled by the CEC, that these systems are superficial and practically do not give an idea of \u200b\u200bthe course of the elections and there is no way to check their reliability. ...

Nevertheless, the concept of GAS "Vybory" provided for the creation of a hierarchical multi-level and multi-channel information structure within the framework of the current system of election commissions in the Russian Federation. Russian embassies and consulates were equipped with automation systems. By 1997, for example, 40 of them had done this167. The technical resources of the GAS "Vybory" system are used in conducting sociological studies of the state and dynamics of electoral culture and voter activity.

Decree of the President of the Russian Federation of February 28, 1995 No. 227 "On ensuring the creation, functioning and development of the State Automated System of the Russian Federation" Vybory "168 became important for the formation of GAS" Vybory ". It solved important problems related to material support, including the provision of office space on a gratuitous lease basis for the installation of software and hardware complexes of the GAS "Vybory", staffing the system. In addition, specific dates were set for the preparation of information for compiling voter lists as of July 1, 1995, i.e. the organization of the National Voter Registration (Accounting) System was approved.

An important place was given to the legal training of the organizers of the electoral process, the organizational and technological foundations of the electoral process at all its stages and levels, including the implementation of the GAS "Vybory". The same training was carried out during the operation of GAS Vybory at regional and local elections, special attention was paid to training in methods of legal protection of this system, organizational connection of all links of the technological process and control over all operations, primarily in the registration of voters and determination of voting results. Since 1995, the position of a system administrator has been introduced in the system of election commissions as an official serving the software and hardware complex of the automated system. Provisions were developed on the level of qualification requirements, the duties of the system administrator, his rights, on the procedure for approval job descriptions system administrator, and also established measures of responsibility for improper fulfillment of their duties, for violation of the order for the safety of the received information and, most importantly, for its reliability, as well as for the preservation of software and hardware accepted for safekeeping.

Personal data about voters in the Vybory database was classified as confidential information. The voter had the right to access documented information only about himself.

In the mid-90s, the Federal Center for Informatization began to be created under the Central Executive Committee of the Russian Federation for the organizational, informational and methodological support of GAS "Vybory". The federal property complex of the GAS "Vybory" system was transferred to the operational management of the created Federal Center. The FCI was a state institution, had an independent balance sheet, possessed separate property, had settlement and other accounts in banking institutions, a stamp and letterheads with its name, and could also act as a plaintiff and defendant in court, conclude agreements, contracts on its own behalf, acquire and carry out property and personal non-property rights, to bear obligations, to answer for his obligations with the funds at his disposal.

The main contractor for the creation of the first stage of GAS "Vybory" was the Federal State Unitary Enterprise "Research Institute" Voskhod ". AOZT Lanit-System, ZAO Argussoft Companies, the 27th Central Research Institute of the Russian Ministry of Defense, OOO Palmintech took part in the development of special software. Faktor-TS LLC, Dialogue-Science CJSC, NIP Informzashita CJSC and some others took part in the development of general software and technical means169. On December 17, 1995, the GAS "Vybory" system was used for the first time at the federal elections of deputies of the State Duma of the second convocation. By election day, about three thousand terminals of the Vybory GAS were equipped, installed in territorial election commissions in most regions of Russia. 87 subjects of the Russian Federation were equipped with complex automation equipment. 79 constituent entities of the Federation ensured the collection and transmission of information via GAS "Vybory", the rest transmitted information in the traditional way. An information board was installed in the building of the Federation Council on Tsvetnoy Boulevard, to which preliminary information received from the regions about voter activity and preliminary voting results was transmitted in an operational visual mode170.

The system was created in the shortest possible time. According to the chief designer of GAS "Vybory" Yu.S. Lomova, “Few believed that such a task was in principle feasible, because in two years it was necessary to design a system of analogues, which was not in the world. The uniqueness of the system consisted, in particular, in the fact that it was designed not only as an electronic counter of voters' votes, but also as a controller of the correctness of their counting, moreover, in accordance with the norms of electoral legislation ”171.

The GAS "Vybory" was put into trial operation in 1996. A stage-by-stage refinement of special software - functional task complexes (FKZ) - was carried out. Considerable attention was paid to the improvement of the system for holding elections to bodies of state power of the constituent entities of the Russian Federation and to bodies of local self-government. The FKZ implemented on the automation systems of the GAS "Vybory" made it possible to ensure a multilevel election.

Implemented as a set of automation equipment complexes (KSA) deployed in the information centers of election commissions and interconnected by switched and dedicated communication channels and personnel providing the operation of these complexes, the system operated at three levels:

KSA CEC, KSA information centers of election commissions of constituent entities of the Russian Federation (88, except for the Chechen Republic) and KSA at information centers of territorial election commissions (2715). For the automation of information processing processes during voting, FKZ were developed: "Voter", "Territory", "Candidate", "Cartography", "Results". To control the use of automation equipment, a special group (control group) was formed in each election commission from among the members of the commission with the right to vote and consult. But it is worth noting that the important principle of functioning of GAS "Vybory" "one KSA per one election commission" failed to be maintained.

Sometimes, one KSA served up to five district election commissions, so it was urgent to develop a number of organizational and technical measures172.

Much attention was paid to the development and experimental use of the functional set of tasks (FKZ) "Pravo" and others, for example "Itogi". In preparation for the elections to the State Duma of the third convocation, a new set of tasks “Control of finances” was developed, which provided information support for the process of control over the special election funds of candidates173.

Consistent development work functionality GAS "Vybory" led to the improvement of special software (SPO). For example, at the end of 1998, open source software version 5.0 was introduced into the system. A new version allowed in a single information process to carry out all the main work on the preparation and conduct of elections. According to statistics, with the use of the GAS "Vybory" system in regional elections, 57 (62.6%) election campaigns out of 91 were held in 1997; in 1998 - 68 (94.4%) out of 72; in 1999 - 69 (95.8%) out of 72; in 2000 - 199 (97%) out of 206, which did not coincide with the elections of the President of the Russian Federation174. The functioning of the system has shown its ability to provide automation of electoral processes during more complex, combined electoral campaigns. Attention was drawn to this and appropriate training of members of election commissions was carried out. On the whole, the system operated without interruptions in receiving and processing information175.

For the 1999/2000 election campaigns special software was improved, including FKZ GAS "Vybory": "Territory", "Planning", "Candidate / Deputy", "Results", version 5.1, which received a certificate from the State Standard of Russia. In order to improve the work email the software version of the Dionysus hosts was replaced, and so on.

It should be noted that the measures taken made it possible to effectively and efficiently obtain the relevant information. All links of the GAS "Vybory" worked as usual. After being submitted to the KSA of the CEC of Russia, the data were submitted to the FCI "Vybory", to the highest state bodies and to the international Internet on the websites of the CEC of Russia (where information on the preliminary results of the elections was updated on-line every hour, starting from 23:00 on March 26, 2000 until 15:00 the next day). In each case, more than 10 thousand documents were converted containing information on the preliminary election results with a cumulative total. At that time, more than 10.5 thousand files were posted on the website of the Central Election Commission of the Russian Federation in the section “Final Results of Elections ”2.

In May 2000, by an act of the state commission, GAS "Vybory" was put into permanent operation3.

At the same time, today some publications again return to the problem of possible election fraud. For example, normative acts give an idea of \u200b\u200bthe GAS “Vybory” only in general terms, documents do not form a coherent system of norms, and public control over the automated processing of results is significantly hampered. Other researchers note that such judgments mislead voters and suggest that the voting results are supposedly predetermined and do not depend on the voters' will.

Eight years of experience in operating GAS "Vybory" (1995) showed a complete lack of possibilities for falsifying election results by the system itself. During this entire period, as noted by the designer of GAS "Vybory", there were no such claims to the courts. The developers completely excluded, and therefore did not implement, the possibility of correcting data in the computers of territorial and district election commissions by higher commissions and the Federal Center for Informatization under the Central Election Commission of the Russian Federation178.

It is worth noting that the detailed parameters for the development of the system, its functioning and means of control over the use were given in fundamental textbooks, which were published under the auspices of the CEC179 and could serve as a guide for well-known researchers in the submission of the relevant material.

At the present stage, the system has been revised and modified (it was reported back in 2000180) and which has now become known as GAS "Vybory-M". The modernized system has new functional and operational capabilities that allow displaying data on the progress and results of voting for each polling station; the volume of transmitted data has been expanded; increased speed of information transmission and processing; digital communication subsystem and subsystem information security, a secure Internet portal, subsystems for video conferencing, display and presentation of information on the Internet and TV and radio companies from the building of the Central Election Commission of Russia.

The system has expanded the possibilities of ensuring openness and publicity in the preparation and conduct of elections, referendums, determination of voting results, determination of election results, referendum. For the first time in world practice, information on preliminary voting results is provided by the media online, within 24 hours the protocols of precinct election commissions on voting results are posted on the Internet.

The updated system has shown its high efficiency during the preparation and conduct of elections of deputies of the State Duma of the Federal Assembly of the Russian Federation of the fourth convocation at the end of 2003 and elections of the President of the Russian Federation in March 2004.

Meanwhile, the issues of the work of GAS "Vybory" and its regulatory framework were still an important area of \u200b\u200bwork of the Central Election Commission of the Russian Federation and the FCI RF181. As A.A. Veshnyakov at a meeting of chairmen of election commissions of the constituent entities of the Russian Federation on August 26, 2003, 97% of the automation systems were fully equipped with the technical means of the modernized GAS Vybory and their deployment in 81 constituent entities of the Russian Federation was fully completed. 46 terrestrial digital communication channels have been laid, of which 15 have already been connected. Work is underway to organize 16 space communication channels, which will be used for the first time in Russia182.

On September 12, 2003, the Procedure for posting data of GAS "Vybory" on the Internet was approved, where, along with general provisions, the procedure for posting information on the Internet was regulated, mandatory information for posting on the website of the CEC of the Russian Federation, in the sections of the sites of election commissions of the constituent entities of the Russian Federation, the addresses of their sites in the Internet portal of the Central Election Commission of Russia were approved183.

With the entry into force of the Federal Law “On the State Automated System of the Russian Federation“ Elections ”, the system legally acquired the status of a federal automated information system.

The modernized GAS elections allowed the 2003 election campaign to be even more successful. 105 thousand pieces of equipment were supplied to the subjects of the federation. Four months before the elections, 3,000 system administrators underwent retraining, and before that (from February to November), their full-time training was conducted on a new special software: 3029 - in service centers, 162 - in Research Institute "Voskhod". It was the largest information project in Europe. By creating a unified database at all objects of the Vybory GAS, expanding the volume of transmitted data (for example, for the complex of tasks "Monitoring of electoral funds - 100 times, the task for" Results "- 30 times), increasing the transmission speed 45 times and information processing, for the first time in world practice, fundamentally new solutions were implemented184.

It is worth noting the significant development of the normative basis of GAS "Vybory".
